Guest Agreement

This Agreement is dated and arranged by SUPERHOG Ltd (“SUPERHOG”) and governs the relationship between you (“Guest”), SUPERHOG and your Host in any Booking. You should read this Agreement carefully and only continue if you wish to be bound by the Agreement in its entirety.

1.   GUEST CONSENT

1.1  To protect the Host’s interest in the Property, the Guest agrees to complete a Booking Validation. This may mean the Guest is required to verify their identity (ID) in advance of the Booking and if asked, the Guest agrees to submit a photographic ID.

1.2  The Host or SUPERHOG, acting as the Host’s Agent, may pass the Guest’s details to a third-party provider to carry out ID verification, and other checks.

1.3  No SUPERHOG guarantees will be active in relation to a Booking if the SUPERHOG Booking Validation has not been completed in advance of the Booking.

2.   PROPERTY DAMAGE

2.1  The Guest acknowledges that they are liable to pay for all Property Damage to, at or in the Property during their Booking which was directly or indirectly caused by their own action or inaction.

2.2  If the Guest does not report Property Damage to the Host or SUPERHOG which can be demonstrated to have been caused during the Booking, then it will be assumed that the Property Damage was caused by the Guest and the Guest accepts liability for the damage.

2.3  The Guest agrees to compensate the Host for any fees or charges the Host might have to pay, including compensation to occupiers of neighboring Property caused by the Guest’s actions or failure to fulfill any of the obligations in this Agreement.

3. DAMAGE DEPOSIT

3.1  Where the payment of a Damage Deposit by the Guest is required for a Booking, the Guest agrees to provide details of a payment card which will remain valid until at least 30 days after the Booking has been completed.

3.2  If Property Damage has occurred, SUPERHOG has the right to draw against the payment card up to the Damage Deposit amount for the Booking as part of compensation for damage that is payable to the Host. No further notice is required from SUPERHOG in order to draw on the payment card up to the Damage Deposit amount, although SUPERHOG must in all cases retain appropriate evidence in relation to the Property Damage.

3.3  SUPERHOG’s right to draw against the payment card will expire at the end of 14 days after the checkout time and date of the booking unless SUPERHOG has notified the Guest by this time of potential Property Damage which requires further investigation. As long as SUPERHOG has given such notice within this timeframe the right to draw against the payment card will extend until the end of any investigation.

3.4  SUPERHOG will give the Guest three working days written notice in advance of taking any payment in relation to Property Damage that is in excess of the Damage Deposit amount.

3.5  Superhog may provide alternative Damage Deposit options to applicable Guests.

4.   PROPERTY USE

4.1  LEASE TERM. The Guest shall be allowed to occupy the Property starting with the reservation’s checkin date at the checkin time and ending on the reservation’s checkout date at the checkout time (“Lease Term”).

4.2  ACCEPTABLE USE. The Property may only be used for purposes permitted by the Host. The Host permits the Property to be used for residential use only. The Guest is not authorized to sell products or services on the Property or conduct any commercial activity.

4.3 ILLEGAL ACTIVITY. The Guest shall use the Property for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of pre-paid Rent.

4.4  BOOKING FEES. The Guest shall pay the Host the amount as detailed during the booking process.

4.5  QUIET HOURS. Quiet hours begin at 9:00 PM each night and continue until sunrise. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents.

4.6  QUIET ENJOYMENT. The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.

4.7  OCCUPANTS. The total number of individuals staying on the Property during the Lease Term shall not exceed the number of guests listed on the reservation.  If you plan to have additional overnight guests, please contact us in advance for approval. Additional fees may apply. Please note that exceeding the maximum occupancy limit may result in a $200 a night penalty for every person over the limit.

If more than the authorized number of guests listed above are found on the Property, this Agreement will be subject to termination by the Host and a $200 a night penalty for every person over the limit.

4.8  UTILITIES. Your booking includes normal usage of utilities, any excessive usage will be charged to the guest.  The home’s thermostats must remain between 66 and 78 degrees.  No tampering with the pool’s heating system.

4.9  PETS. The Host does not allow pets: There are no pets allowed on the Property. If the Guest is found to have pets on the Property, this Agreement and any Security Deposit shall be forfeited.  If you require a service animal, you must notify us in advance so that we can make the necessary arrangements. Any unauthorized animals will be subject to an additional fee. Damage or additional cleaning charges attributable to animals shall be charged to you, together with a fine of $100 per day with a minimum of $500.

4.10  SMOKING. Smoking on the Property is prohibited.  This includes smoking of any kind (cigarettes, vaporizers, etc) is not allowed in our property or on its grounds. If you are found to be smoking on the property, you will be subject to a fine fee of $250 plus damages, and you may be asked to leave the property immediately without a refund. We do not permit the use of electronic cigarettes or vaporizers in our property.

4.11  SUBLETTING. The guest does not have the right to sublet the Property.

4.12  INSPECTION. The Host has the right to inspect the Property with prior notice as in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the Property upon termination of the rental period. The Guest shall vacate the Property at the expiration time and date of this agreement.

4.13  MAINTENANCE AND REPAIRS. The Guest shall maintain the Property in a good, clean, and ready-to-rent condition and use the Property only in a careful and lawful manner. The Guest shall leave the Property in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Property be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Property or its furnishings. 

4.14  TRASH. The Guests shall dispose of all waste material generated during the Lease Term under the strict instruction and direction of the Host. 

4.15  HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Property regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired.

4.16  ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement. 

4.17  POSSESSIONS. Any personal items or possessions that are left on the Property are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.

4.18  CHECKOUT. Checkout time is 11am for all guests. We kindly ask that you vacate the property by this time to allow our cleaning staff to prepare the property for the next guests. If you require a late check-out, please contact us in advance to discuss availability and any additional fees that may apply. Failure to vacate the property by 11am without prior approval may result in a $50 charge per hour.  If you remain on the property beyond the check-out time and date without approval, we may need to ask you to leave and secure the property. If this is necessary, we will ensure that your personal belongings are kept safe until retrieved.

4.19  HEATED POOL.  The pool thermostat will be set to maintained between 82 and 94 degrees during the operational season from March to October.  The actual temperature of the water will vary depending on weather conditions and other environmental constraints.

4.20  POOL SAFETY.  Guests are responsible for their own safety and should use the pool at their own risk. Diving is not allowed in the pool, as the depth may not be suitable for diving. Running on the pool deck or in the pool area is prohibited, as it increases the risk of slipping and falling.  Glass containers are not allowed near the pool, as broken glass can cause serious injuries.  Guests will be financially responsible for glass breakage in the pool cleaning costs. Food and drinks are not allowed in the pool, to keep the water clean and prevent accidents.

Children under the age of 18 must be supervised by an adult at all times when in the pool area. Guests are not allowed to swim alone, and should have at least one other person present when using the pool. 

5.   GUEST OBLIGATIONS AND ACKNOWLEDGEMENTS

5.1  The Guest acknowledges that they are liable for all costs associated with damage to, at or in the Property during their Booking which was directly or indirectly caused by their own action or inaction.

5.2  The Guests acknowledges that they are liable for the full reservation amount owed to the Host and any cancellation or refund is subject to the Host’s cancellation terms.

5.3  The Guest agrees not to make a Chargeback against the Host.

5.4  The Guest always agrees to use the Property only as permitted by the Host and always in a reasonable and responsible manner.

5.5  The Guest takes full responsibility for the behavior of any person they have permitted to enter the Property.

5.6  The Guest agrees to act as soon as they become aware of any Property Damage or problem to minimize its effects and prevent it becoming worse or causing nuisance to the occupier of any neighboring Property.

5.7  Wherever possible the Guest will take a photographic record of the property at the start and the end of the Booking and upload to SUPERHOG. If the Guest chooses not to do this the Guest acknowledges that it will be hard for them to prove that they did not cause the damage.

5.8  The Guest will take steps to ensure the security of the Property.

5.9  The Guest will take care to avoid blocking or causing damage to drains or sanitary appliances.

5.10 The Guest will keep the Property appropriately and safely ventilated to ensure that there is no build-up of damp or moisture or of cooking smells, smoke, or grease.

5.11 All obligations on the Guest in respect of the Property apply equally in relation to any building of which the Property forms part and in relation to any access, parking, or right of way associated with the Property.

5.12 The Guest acknowledges that the cost of Property Damage will be determined at SUPERHOG’s sole discretion.

6.   AGREEMENT

6.1  The Agreement sets out the terms on which SUPERHOG provides services in respect of a Booking. By entering into the Agreement you also agree to our Website Terms and Privacy and Data Protection policy which you can find at www.superhog.com. It is important that you read the Agreement carefully as your continuation through the SUPERHOG process constitutes acceptance of these terms and the associated obligations.

6.2  To the extent this Agreement is signed by an agent or representative of a Guest, it is deemed to also bind the Guest, and that the Guest has expressly agreed to the terms in this Agreement.

6.3  You agree that SUPERHOG may pass on certain information to the Host in connection with the Booking if this is deemed relevant.

6.4  You agree that if you have caused Property Damage and not met your associated liabilities then your details may be held by SUPERHOG on a Watchlist.

7.   GENERAL

7.1  Any notices required under this agreement will be deemed if sent by email to the Guest, provided that no such notification of non-delivery is received, and the notice will be deemed served eight hours after sending of the email.

7.2  The unenforceability or invalidity of any clause in this Agreement shall not have an impact on the enforceability or validity of any other clause.

7.3  This agreement is governed by and construed in accordance with the laws of The United States of America. The Host and Guest agree to submit to the exclusive jurisdiction of the United States courts.
